Welcome to The Sweet Setup! These Terms of Service ("Terms") govern your use of our website and services related to the design, setup, and delivery of custom candy buffet tables for events in Oregon.

By accessing or using our website, booking services, or making a payment, you agree to these Terms. If you do not agree, please do not use our services or website.

1. Services

The Sweet Setup provides custom candy buffet tables for private and public events such as weddings, birthdays, corporate events, and more. Our services include:

  • Custom design and setup of candy buffet tables

  • Delivery, setup, and takedown

  • Candy and decoration selection based on themes

  • Rental of display items (backdrop, linens, jars, scoops, tongs, goodie bags etc.)

We operate primarily within the Portland Metro Area, Oregon. If you are outside of this area please contact us.

2. Booking and Payment

  • Deposits: A non-refundable deposit of $100 is required at the time of booking to reserve your event date. Your deposit will be applied towards the purchase you have made.

  • Final Payment: The remaining balance is due no later than 7 days before your event.

  • Payment Methods: We accept payments via credit card, Venmo, cash.

  • Cancellations: We understand that plans can change, and we strive to be as flexible as possible while also ensuring we’re able to prepare accordingly for your event.

    • A $100 deposit is required to secure your event date. Please note that this deposit is non-refundable, as it covers initial planning, supplies, and time spent reserving your date.

    • Final Payment Refunds:

      • If you have made your final payment and cancel 21 days or more before your event, you are eligible for a refund of your final payment, minus the $100 non-refundable deposit.

      • If you cancel within 21 days of your event, your eligibility for a refund is at our discretion, depending on the nature of the cancellation and any preparations already made.

      • If you choose to cancel your event and do not wish to reschedule, we reserve the right to determine the refund amount based on the circumstances and timing of your cancellation.

    We truly appreciate your understanding and cooperation, and we are always happy to work with you to reschedule when possible.

  • Rescheduling: We offer a one-time rescheduling at no additional cost, as long as the new date is booked within one year of your original event date. Any additional rescheduling requests will incur a $100 fee.

  • Quotes are valid for 14 days from the date issued.

  • How to Cancel: All cancellation requests must be submitted in writing via email or on The Sweet Setup’s website by the specified deadline.

  • Exceptions: We understand that emergencies happen. We review exceptions, such as documented medical or family emergencies, on a case-by-case basis. We can reschedule the event for a different date.

  • We offer table breakdown and pickup services until 11:00 PM. For any services required after 11:00 PM, an after-hours fee of $100 will apply. Similarly, our standard setup time begins at 6:00 AM. If you require setup prior to 6:00 AM, a before-hours fee of $100 will be added.

3. Allergies & Dietary Restrictions

We do our best to accommodate allergies or dietary needs (e.g., nut-free, gluten-free, vegan) if notified in advance. However, we are not a certified allergen-free facility and cannot guarantee against cross-contamination.

By using our services, you acknowledge and accept all risks related to food allergies and dietary restrictions.

While we make every effort to source quality, safe treats and candies, we cannot guarantee products are free of allergens such as peanuts, tree nuts, dairy, soy, wheat, or gluten.

  • It is the client’s responsibility to notify guests of potential allergens.

  • We are not liable for allergic reactions or food sensitivities.

4. Decor & Rental Items

  • All jars, trays, dishes, backdrops, drapery, scoops, tongs, and other décor items are property of The Sweet Setup and must be returned in original condition.

  • Goodie bags are included for guest use and may be taken home.

  • Remaining candy after the event is yours to keep unless otherwise specified in your package.

  • The client is responsible for any equipment that is lost, stolen, or damaged beyond normal wear and tear during the rental period. In such cases, the client agrees to cover the cost of repair or replacement at full market value. An invoice for any damages or losses will be provided and must be paid within 7 days of receipt.

5. Delivery & Travel Fees

  • Free delivery within a 30-mile radius of our base location in Washington County, Oregon.

  • A delivery fee of $1.25 per mile applies for events located 30 miles or more from our base location (calculated round trip).

  • Parking access must be made available for setup and breakdown.

6. Setup & Cleanup

  • Setup begins approximately 1–2 hours prior to the event start time.

  • Cleanup begins at the agreed-upon event end time.

  • Clients are responsible for ensuring the venue allows early access for setup and agrees to the décor and rental elements being used.

  • Any damages to rental items caused by guests or venue negligence may result in a replacement or repair fee.

7. Weather & Outdoor Events

  • For outdoor events, a shaded and weather-protected area must be provided.

  • The Sweet Setup reserves the right to cancel or modify setup in unsafe weather conditions (rain, high wind, extreme heat).

8. Client Responsibilities

You agree to:

  • Provide accurate information during booking.

  • Obtain any necessary event permissions or venue approvals, i.e. if event space has any unique requirements such as rubberized table feet  protectors or if the use of ground anchors is allowed in the outdoor space.

  • Supervise children around the candy buffet table.

  • Return or pay for any damaged or lost rental items.

9. Use of Website

By using our website, you agree not to:

  • Engage in any unlawful or fraudulent activity.

  • Attempt to gain unauthorized access to our systems.

  • Use our content or images without permission.

All website content, including images, logos, and text, is owned by The Sweet Setup and protected under intellectual property laws.

10. Limitation of Liability

To the fullest extent allowed by law, The Sweet Setup and its owners, employees, or agents shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to food-related illnesses, allergic reactions, or property damage.

Our liability is limited to the amount you paid for the service in question.

  • The Sweet Setup is not responsible for any injuries or accidents involving the candy buffet, décor, or food items during or after the event.

  • Clients assume full responsibility for their guests' interaction with the buffet and décor elements.

11. Photography & Promotion

  • We may take photographs of your candy buffet setup for promotional use on our website and social media.

  • If you prefer not to have your event featured, please notify us in writing at the time of booking.

12. Agreement

By booking a service with [Your Business Name], you agree to the terms outlined above. A signed contract will be provided at the time of booking to confirm acceptance.

13. Service Modification

The Sweet Setup reserves the right to modify, suspend, discontinue, restrict, or disable all or part of its services under this Agreement, including but not limited to candy selections, jar count, setup/breakdown times, display configurations, or other service components, in the event of circumstances such as:

‑ Venue constraints or requirements
‑ Unavailability of certain supplies or products
‑ Safety concerns or hazards
‑ Regulatory or permit changes
‑ Inclement weather or other force majeure events
‑ Other unforeseen or beyond‑reasonable control of events

In such circumstances:

  1. Notice to Client
    The Provider shall give the Client written or electronic notice of any modification as soon as reasonably practicable after becoming aware of the need for the change.

  2. Alternative Options
    Whenever possible, the Provider will propose alternative options of equivalent value or service to accommodate the Client.

  3. Adjustment of Fees
    If the modification materially alters the scope of services, the Provider reserves the right to adjust the fees accordingly. Any such adjustment must be communicated to and agreed by the Client in writing before the change is implemented.

  4. No Breach Where Good Faith Exists
    The Client agrees that modifications under this clause shall not constitute a breach of contract provided that the Provider acts in good faith, gives appropriate notice, and endeavours to mitigate impact.

  5. Limitation of Liability
    The Sweet Setup shall not be liable for indirect, special, or consequential damages arising from modifications under this clause except in cases of gross negligence or willful misconduct.

  6. Contract Modification & Enforceability Under Oregon Law
      a. Pursuant to ORS 72.2090, a modification of an existing contract under Oregon law need not have new consideration to be binding, so long as the parties agree in good faith. OregonLaws
      b. If the Agreement expressly requires modifications to be in writing, then any modification under this clause must be documented in writing and signed by both parties. This ensures enforceability and compliance with ORS 72.2090(2). OregonLaws
      c. The Client agrees that this clause is not unconscionable, oppressive, or otherwise lacking a reasonable relationship to business risk, in light of ORS 72.3020. Should any part of this clause be deemed unconscionable, it may be limited or severed to avoid an oppressive result. OregonLaws

  7. Effective Date of Modification
    Any modification under this clause will take effect on the date agreed to in writing by both parties (or as specified in the notice), and shall be binding once effective.

14. Warranty and Warranty Disclaimers

1. Express Warranty
The Sweet Setup warrants that the candy buffet table service will be performed in a professional manner consistent with industry standards, using clean equipment, properly packaged candy, and safe handling practices. If any candy is found to be spoiled, damaged, or otherwise unsatisfactory upon delivery or setup, The Sweet Setup will replace the impacted items or refund the portion of the service charge related to those items, provided the Client gives written notice within 24 hours of the event or setup.

2. Implied Warranties Under Oregon Law
Under Oregon law, certain implied warranties automatically apply unless properly disclaimed. These include:

  • The implied warranty of merchantability, under ORS 72.3140, which means that goods (in this case candy and related items) shall, unless excluded, be fit for ordinary use, meet reasonable consumer expectations, be properly contained, packaged, and labeled. OregonLaws

  • The implied warranty of fitness for a particular purpose, under ORS 72.3150, when the seller knows of a particular purpose for which the goods are needed and the buyer is relying on the seller’s skill to select suitable goods. OregonLaws

3. Disclaimers / Limitations of Implied Warranties
To the maximum extent permitted by Oregon law:

  • EXPRESS WARRANTIES (as described above) are the only warranties provided. All other warranties, whether express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose, are hereby disclaimed, except as required by law.

  • Any disclaimers of implied warranties shall be in writing and conspicuous, and shall include the word “merchantability” where required under ORS 72.3160. FindLaw Codes+1

  • The goods and services are provided "as is" and "with all faults" insofar as those terms are permitted under Oregon law.

4. Limitations of Remedies

  • The Client’s exclusive remedy (and the Provider’s only obligation) under this warranty shall be the repair, replacement, or refund described above.

  • The Sweet Setup shall not be liable for any incidental, special, indirect, or consequential damages (including lost profits or losses due to delay), even if The Sweet Setup has been advised of the possibility of such damages, except where such damages are required by law.

  • Any claim for breach of warranty must be made in writing within 21 days of the event or setup (or such earlier period as required by law), or the warranty is waived.

5. Severability & Governing Law

  • If any part of this Warranty / Warranty Disclaimer clause is held invalid or unenforceable under Oregon law, that part shall be modified or severed to the extent necessary, while the remainder of the clause shall remain in full force and effect.

  • This Agreement and all warranties (express, implied, or disclaimed) shall be governed by the laws of the State of Oregon.

15. Indemnification

You agree to indemnify and hold harmless The Sweet Setup, its employees, and affiliates from any claims, liabilities, damages, or expenses arising out of your use of our services or website.

16. Privacy Policy

Your privacy is important to us. Please refer to our Sweet Privacy Policy for information on how we collect, use, and protect your data.

17. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services or website constitutes acceptance of any changes.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon. Any disputes shall be resolved in the state or federal courts located in Washington County, Oregon. OregonLaws
